Mercury Bay Medical Centre Terms and Conditions

General
These Terms and conditions apply to the transactions related to our services at Mercury Bay Medical Centre. You may be bound by additional contracts related to your relationship with us or any services that you receive from us. If any provisions of the additional contracts conflict with any provisions of these Terms, the provisions of these additional contracts will control and prevail.
These Terms are governed by and will be construed in accordance with the laws of New Zealand and you submit to the non-exclusive jurisdiction of the Courts of New Zealand. If any part of provision of the Terms is deemed to be invalid, unenforceable or illegal, the remaining provisions shall remain in full force and effect.
We may in our reasonable discretion change these Terms, or any aspect of the subscription by posting the changes on our website. Your continued use of our services after any such change constitutes your acceptance of the change.
By registering with our practice, you hereby agree to be bound by these Terms and conditions set forth below. The use of our services implies the knowledge and acceptance of these Terms and conditions. In some particular cases, we can also ask you to explicitly agree.
To access our services, you may be required to provide certain information about yourself as part of the registration process. You agree that any information you provide will always be accurate, correct, and up to date.
Except for obligations to pay money hereunder, no delay, failure or omission by either party to carry out or observe any of its obligations hereunder will be deemed to be a breach of these Terms and conditions if and for as long as such delay, failure or omission arises from any cause beyond the reasonable control of that party.
You agree to indemnify, defend and hold us harmless, from and against any and all claims, liabilities, damages, losses and expenses, relating to your violation of these Terms and conditions, and applicable laws, including intellectual property rights and privacy rights. You will promptly reimburse us for our damages, losses, costs and expenses relating to or arising out of such claims.
Failure to enforce any of the provisions set out in these Terms and Conditions and any Agreement, or failure to exercise any option to terminate, shall not be construed as waiver of such provisions and shall not affect the validity of these Terms and Conditions or of any Agreement or any part thereof, or the right thereafter to enforce each and every provision.

Pricing
A current price list is available at Reception. Prices quoted for services may be adjusted from time to time, and the customer hereby agrees to pay any such adjusted price. Prices include GST unless otherwise stated.

Payment
You acknowledge that: a) All services may attract a fee; and b) you remain liable for all fees, costs and disbursements (e.g. Laboratory testing) charged by us for the services provided notwithstanding that these may be recoverable by us from a third party (e.g. insurance providers).
Payment shall be accepted in the form of cash, EFTPOS, credit card or direct credit. Surcharges may apply for some card types.
Unless otherwise agreed, all services shall be paid for on the date of service. Mercury Bay Medical Centre may withhold further provision of service where there is any outstanding amount due except in an emergency.
We reserve the right to ask for payment on arrival (before a service is provided, to ensure payment); this may apply to: visitors / casual or non enrolled patients, first appointment for new patients. those who have an outstanding account, those who have had a previous debt with us.
We will work with our patients who are concerned about their ability to pay. It is best to arrange a payment plan that is acceptable and manageable rather than letting debt accumulate. Please discuss your account with the Practice Manager. Setting up regular weekly or fortnightly automatic payments can be very useful to help manage your account.
Refunds can be requested for services that have not been provided. The refund request must be made within 20 working days. To request a refund, please contact Reception.
Where it is agreed that payment need not be paid on the day of service, it shall be paid by 20th of the month, following date of invoice. An admin fee of $15 may be automatically added and it shall be paid within 7 days of the date of the service/invoice. If payment is not made immediately, we will invoice you and will charge you an administration fee for doing so. Where payment is not made on the day, a $15 administration fee will apply, this will be removed if payment is received by close of business next day.
Interest may be charged on overdue accounts at a rate to be decided by Mercury Bay Medical Centre from time to time.
Collection fees and costs incurred to recover outstanding monies will be payable by the customer.

Cancellations
A cancellation fee may be charged if you fail to keep an appointment or give less than 2 hours notice of cancellation. The fee charged will be at the standard consult rate for the time booked. A fee can be charged for non-attendance or an appointment cancelled with insufficient notice.

Privacy
Mercury Bay Medical Centre agrees not to use or disclose any information more than is reasonably necessary in the circumstances for its genuine business purposes. Mercury Bay Medical Centre may disclose my personal information in order to provide credit references to other agencies that request them, and for debt collection, repossession, credit reporting and other similar purposes.
